These Terms of Use ("Terms") govern your access to and use of the TonimusAI websites, applications, APIs, and related services (collectively, the "Service"). TonimusAI provides tools for creators—including podcasters and similar professionals—to automate workflows, manage content-related tasks, grow audience engagement, and analyze performance, as described on our marketing pages and in-product experiences. Features may change over time; we may add, modify, suspend, or discontinue functionality with or without notice when reasonably necessary for security, compliance, or operations.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AUTOMATION OR RECOMMENDATIONS WILL ACHIEVE ANY PARTICULAR BUSINESS OR AUDIENCE OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONIMUSAI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
You will defend, indemnify, and hold harmless TonimusAI and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service. Provisions that by their nature should survive will survive termination (including Sections 5, 8–11, and 13–15).
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless a different governing law is required where you reside. Courts located in Delaware will have exclusive jurisdiction for disputes, subject to mandatory consumer protections in your country of residence where applicable.
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. If changes are material, we will provide additional notice as required by law (for example, by email or in-product notice). Your continued use after the effective date constitutes acceptance of the revised Terms.
